AGREEMENT TO TERMS
These Resident Terms and Conditions (the “Resident Terms and Conditions”) constitute a legally binding agreement between you (“you”) and Pest Share, Inc. (“Pest Share,” “Company,” “we,” “us,” or “our”) concerning your request for, receipt of, access to, and use of pest-control coordination services made available by Pest Share and the underlying pest control service provided thereunder (the “Resident Services”). The Resident Services may be made available to you pursuant to a written agreement between Pest Share and the property manager, landlord, or owner responsible for your unit or service location (your “Property Manager”), and you acknowledge and agree that the nature, scope, coverage, availability, and limitations of the Resident Services may be determined by, and provided subject to, that agreement. The Resident Services may be requested through the Services (as defined in the Pest Share Terms of Service), by email, by text message, through your Property Manager, or through any other channel we make available. Pest Share may arrange for Resident Services to be performed by independent third-party service providers in connection with Pest Share’s arrangements with your Property Manager. For clarity, these Resident Terms and Conditions are solely between you and Pest Share and do not create
any contractual relationship between you and any Property Manager or third-party service provider. These Resident Terms and Conditions supplement, and incorporate by reference, the Pest Share Terms of Service (available at https://www. pestshare. com/terms-of-service/), as amended from time to time (the “Pest Share Terms of Service”), except to the extent these Resident Terms and Conditions expressly state otherwise. By requesting, receiving, accessing, or using any Resident Services, you acknowledge that you have read, understood, and agree to be bound by these Resident Terms and Conditions and the Pest Share Terms of Service as so incorporated. Additional terms, conditions, or documents applicable to particular Resident Services may be provided from time to time and are hereby incorporated herein by reference. Changes to these Resident Terms and Conditions will be made in accordance with the Pest Share Terms of Service, and your continued use of the Resident Services after any revised version becomes effective constitutes your acceptance of the revised Resident Terms and Conditions.
By using the Resident Services, you represent, warrant, and agree that: (1) the information you provide to Pest Share is and will remain true, accurate, current, and complete; (2) you have the legal capacity and authority to agree to these Resident Terms and Conditions and, if applicable, to authorize access to the applicable property, unit, room, or other service location; (3) you will use the Resident Services only for lawful purposes; (4) you will cooperate reasonably with Pest Share and any assigned third-party service provider in connection with scheduling, access, preparation, treatment, follow-up, and related
communications; and (5) you will comply with any reasonable instructions, requirements, or preparation steps provided by Pest Share, the applicable Property Manager, or the assigned third-party service provider. If you provide any information that is untrue, inaccurate, not current, or incomplete, or if you breach these Resident Terms and Conditions, we have the right to suspend or terminate your account, refuse or cancel any service request, and refuse any current or future use of the Resident Services (or any portion thereof).
We reserve the right, in our sole discretion and without liability except as required by applicable law, to approve, refuse, reschedule, limit, defer, or cancel any service request; to determine service availability, scope, timing, and fulfillment parameters; to assign, reassign, or replace any third-party service provider; and to impose reasonable conditions relating to safety, access, preparation, suspected misuse, non-covered conditions, or noncompliance with these Resident Terms and Conditions. To the extent Resident Services are covered under Pest Share’s arrangement with the applicable Property Manager, Company may limit covered services for an enrolled unit to four (4) service requests, with a maximum of three (3) covered pests per service request, during any rolling twelve (12) month period measured from the date of the first covered service request, unless a different limit applies under the applicable lease or Property Manager arrangement. If your Pest Share benefits are provided pursuant to a lease agreement, please consult the “services per year” and “covered pest per service” limitations contained in your lease agreement.
Any limitations on the services per year or covered pests per service figures contained in your lease agreement will control in the event of a direct conflict with the services per year or covered pests per service figures set forth above. You are responsible for being reasonably available and providing timely access as needed to complete your service request in a safe and effective manner. By requesting Resident Services, you authorize Pest Share and any assigned third-party service provider to contact you and, if applicable, to coordinate entry to the service location with you, your Property Manager, building staff, or other persons reasonably believed to have authority to provide access. If you fail to provide required access, fail to complete required preparation steps, are unavailable after reasonable attempts to contact you, or cancel or request rescheduling less than twenty-four (24) hours before a scheduled appointment, we may treat the appointment as a completed or missed service request for purposes of applicable service limits, and we may charge you, or cause you to be charged, for any non-covered services, missed trip fees, cancellation fees, or other out-of-pocket costs to the extent permitted by applicable law and any applicable Property Manager arrangement.

By requesting, receiving, accessing, or using the Resident Services, you acknowledge and agree that Pest Share may collect, use, and disclose information as described in the Privacy Policy and the Pest Share Terms of Service.
These Resident Terms and Conditions remain in full force and effect while you request, receive, access, or use any Resident Services. WITHOUT LIMITING ANY OTHER PROVISION OF THESE RESIDENT TERMS AND CONDITIONS OR THE PEST SHARE TERMS OF SERVICE, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITH OR WITHOUT PRIOR NOTICE, AND WITHOUT LIABILITY EXCEPT AS REQUIRED BY APPLICABLE LAW, DENY, RESTRICT, SUSPEND, OR TERMINATE YOUR ACCESS TO OR USE OF ANY RESIDENT SERVICES, OR REFUSE, CANCEL, OR LIMIT ANY SERVICE REQUEST, FOR ANY REASON OR NO REASON, INCLUDING FOR ANY ACTUAL OR SUSPECTED BREACH OF THESE RESIDENT TERMS AND CONDITIONS, THE PEST SHARE TERMS OF SERVICE, APPLICABLE LAW, PROPERTY RULES, OR SAFETY REQUIREMENTS.
If we terminate or suspend your account or access to Resident Services for any reason, you are prohibited from registering for, requesting, or using Resident Services again under your name, a false or borrowed name, or the name of any third party, even if acting on behalf of that third party, without our prior written consent. In addition to terminating or suspending access, we reserve the right to take appropriate legal action, including without limitation seeking available legal or equitable remedies.
We reserve the right to change, modify, suspend, or discontinue any aspect of the Resident Services at any time or for any reason without notice, including service features, availability, coverage scope, fulfillment methods, and scheduling practices, and to change fees for non-covered services (upon reasonable notice to you solely to the extent such notice is required by applicable law), without liability except as required by applicable law or any applicable Property Manager arrangement. We cannot guarantee the Resident Services will be available at any particular time, in any particular location, or for any particular issue, delays, rescheduling, interruptions, or errors. We may experience hardware, software, or other problems or need to perform maintenance related to the Resident Services, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Resident Services at any time or for any reason without notice to you.
You agree that, to the fullest extent permitted by applicable law, we have no liability for any loss, damage, or inconvenience caused by your inability to access or use the Resident Services during any downtime or discontinuance of the Resident Services. Resident Services are not emergency services, and Pest Share does not undertake to provide immediate response, on-demand treatment, medical advice, remediation, repair, or any health or safety intervention. If you believe there is an emergency, an immediate health or safety risk, or a condition requiring urgent remediation, contact the appropriate emergency responders, property management personnel, or other appropriate professionals immediately. Nothing in these Resident Terms and Conditions will be construed to obligate us to maintain and support the Resident Services or to supply any corrections, updates, or releases in connection therewith.
These Resident Terms and Conditions and your use of the Resident Services are governed by and construed in accordance with the laws specified in the Pest Share Terms of Service, without regard to applicable conflict-of-law principles to the extent provided therein.
Any dispute, claim, or controversy arising out of or relating to these Resident Terms and Conditions or the Resident Services will be governed by the dispute-resolution, arbitration, venue, class-action waiver, jury-trial waiver, choice-of-law, and limitations provisions set forth in the Pest Share Terms of Service, which are incorporated herein by reference and apply to the maximum extent permitted by law.
THE RESIDENT SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, AND YOUR USE OF THE RESIDENT SERVICES IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, PEST SHARE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE RESIDENT SERVICES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON- INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, OR RESULTS. WITHOUT LIMITING THE FOREGOING, PEST SHARE DOES NOT WARRANT THAT ANY SERVICE REQUEST WILL BE ACCEPTED, SCHEDULED, OR COMPLETED; THAT ANY PARTICULAR THIRD-PARTY
SERVICE PROVIDER WILL BE AVAILABLE; THAT ANY TREATMENT WILL BE SUCCESSFUL, SUFFICIENT, OR ERROR-FREE; THAT ANY CONDITION WILL BE FULLY RESOLVED OR WILL NOT RECUR; OR THAT THE RESIDENT SERVICES ARE SUITABLE FOR EMERGENCY, MEDICAL, HEALTH, HABITABILITY, STRUCTURAL, OR REMEDIATION PURPOSES. PEST SHARE IS NOT RESPONSIBLE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FOR THE ACTS, OMISSIONS, PRODUCTS, SERVICES, OR WORKMANSHIP OF ANY PROPERTY MANAGER OR THIRD-PARTY SERVICE PROVIDER, AND ANY SUCH PERSONS OR ENTITIES ARE NOT AGENTS OF PEST SHARE FOR PURPOSES OF CREATING LIABILITY TO YOU.
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE RESIDENT SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE LESSER OF THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION
ARISING OR $5,000. THE FOREGOING LIMITATIONS APPLY REGARDLESS OF THE FORM OF ACTION AND EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE. CERTAIN US STATE LAWS AND INTERNATIONAL LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
These Resident Terms and Conditions, together with the Pest Share Terms of Service and any additional terms incorporated by reference herein, constitute the entire agreement between you and Pest Share with respect to the Resident Services and supersede prior understandings between you and Pest Share on that subject. In the event of a direct conflict between these Resident Terms and Conditions and the Pest Share Terms of Service, these Resident Terms and Conditions control solely with respect to the Resident Services and solely to the extent of that direct conflict. Pest Share may assign or transfer these Resident Terms and Conditions, in whole or in part, without restriction, and you may not assign them without Pest
Share’s prior written consent. If any provision of these Resident Terms and Conditions is held unlawful, void, or unenforceable, that provision will be deemed severable and the remaining provisions will remain in full force and effect. No waiver by Pest Share will be deemed a further or continuing waiver of any term or condition or any other term or condition. Nothing in these Resident Terms and Conditions creates any joint venture, partnership, employment, agency, fiduciary, or similar relationship between you and Pest Share, any Property Manager, or any third-party service provider.

ACEPTACIÓN DE LOS TÉRMINOS
Estos Términos y Condiciones para Residentes (los “Términos y Condiciones para Residentes”) constituyen un acuerdo legalmente vinculante entre usted (“usted”) y Pest Share, Inc. (“Pest Share,” “Compañía,” “nosotros,” “nos,” o “nuestro”) respecto a su solicitud, recepción, acceso y uso de los servicios de coordinación de control de plagas disponibles por Pest Share y el servicio de control de plagas subyacente proporcionado bajo el mismo (los “Servicios para Residentes ”). Los Servicios para Residentes pueden estar disponibles para usted en virtud de un acuerdo escrito entre Pest Share y el administrador de la propiedad, arrendador u propietario responsable de su unidad o lugar de servicio (su “Administrador de la Propiedad”), y usted reconoce y acepta que la naturaleza, alcance, cobertura, disponibilidad y limitaciones de los Servicios para Residentes pueden ser determinados por, y proporcionados sujeto a, ese acuerdo. Pest Share puede organizar que los Servicios para Residentes sean realizados por terceros proveedores de servicios independientes en relación con los acuerdos de Pest Share con el Administrador de la Propiedad. Para mayor claridad, estos Términos y Condiciones para Residentes son únicamente entre usted y Pest Share y no crean ninguna relación contractual entre usted y ningún Administrador de la Propiedad o proveedor de servicios de terceros. Al solicitar, recibir, acceder o usar cualquiera de los Servicios para Residentes, usted reconoce que ha leído, entendido y acepta estar sujeto a estos Términos y Condiciones para Residentes y a los Términos de Servicio de Pest Share según se incorporan. Los términos, condiciones o documentos adicionales aplicables a servicios específicos para Residentes pueden ser proporcionados ocasionalmente y se incorporan por referencia en este documento. Los cambios a estos Términos y Condiciones para Residentes se realizarán de acuerdo con los Términos de Servicio de Pest Share, y su uso continuado de los Servicios para Residentes después de que cualquier versión revisada entre en vigor constituye su aceptación de los Términos y Condiciones para Residentes revisados.
Al usar los Servicios para Residentes, usted declara, garantiza y acepta que: (1) la información que proporciona a Pest Share es y seguirá siendo verdadera, precisa, actual y completa; (2) tiene la capacidad legal y la autoridad para aceptar estos Términos y Condiciones para Residentes y, si corresponde, para autorizar el acceso a la propiedad, unidad, habitación u otro lugar de servicio aplicable; (3) utilizará los Servicios para Residentes solo para fines legales; (4) cooperará razonablemente con Pest Share y cualquier tercero proveedor de servicios asignado en relación con la programación, acceso, preparación, tratamiento, seguimiento y comunicaciones relacionadas; y (5) cumplirá con cualquier instrucción, requisito o paso depreparación razonable proporcionado por Pest Share, el Administrador de la Propiedad correspondiente o el tercero proveedor de servicios asignado.
Si proporciona alguna información que sea falsa, inexacta, no actual o incompleta, o si incumple estos Términos y Condiciones para Residentes, tenemos el derecho de suspender o cancelar su cuenta, rechazar o cancelar cualquier solicitud de servicio, y rechazar cualquier uso actual o futuro de los Servicios para Residentes (o cualquier parte de ellos).
Nos reservamos el derecho, a nuestra exclusiva discreción y sin responsabilidad excepto en la medida en que lo exija la ley aplicable, a aprobar, rechazar, reprogramar, limitar, aplazar o cancelar cualquier solicitud de servicio; determinar la disponibilidad del servicio, el alcance, el tiempo y los parámetros de cumplimiento; asignar, reasignar o reemplazar a cualquier tercero proveedor de servicios; y imponer condiciones razonables relacionadas con la seguridad, el acceso, la preparación, el uso indebido sospechado, las condiciones no cubiertas o el incumplimiento de estos Términos y Condiciones para Residentes. En la medida en que los Servicios para Residentes estén cubiertos bajo el acuerdo de Pest Share con el Administrador de la Propiedad correspondiente, la Compañía puede limitar los servicios cubiertos para una unidad inscrita a cuatro (4) solicitudes de servicio, con un máximo de tres (3) plagas cubiertas por solicitud de servicio, durante cualquier período móvil de doce (12) meses medido desde la fecha de la primera solicitud de servicio cubierta, a menos que un límite diferente aplique bajo el contrato de arrendamiento o acuerdo con el Administrador de la Propiedad. Si sus beneficios de Pest Share se proporcionan según un contrato de arrendamiento, consulte las limitaciones de “servicios por año” y “plaga cubierta por servicio” contenidas en su contrato de arrendamiento. Cualquier limitación en las cifras de servicios por año o plagas cubiertas por servicio contenidas en su contrato de arrendamiento prevalecerá en caso de conflicto directo con las cifras de servicios por año o plagas cubiertas por servicio establecidas anteriormente.
Usted es responsable de estar razonablemente disponible y de proporcionar acceso oportuno según sea necesario para completar su solicitud de servicio de manera segura y efectiva. Al solicitar Servicios para Residentes, usted autoriza a Pest Share y a cualquier proveedor de servicios externo asignado a contactarlo y, si corresponde, a coordinar la entrada al lugar del servicio con usted, su Administrador de la Propiedad, el personal del edificio u otras personas razonablemente consideradas con autoridad para proporcionar acceso. Si no proporciona el acceso requerido, no completa los pasos de preparación necesarios, no está disponible después de intentos razonables de contactarlo, o cancela o solicita reprogramar con menos de veinticuatro (24) horas de anticipación a una cita programada, podemos tratar la cita como una solicitud de servicio completada o perdida a efectos de los límites de servicio aplicables, y podemos cobrarle, o hacer que se le cobre, por servicios no cubiertos, tarifas por viajes perdidos, tarifas de cancelación u otros costos de bolsillo en la medida permitida por la ley aplicable y cualquier acuerdo con el Administrador de la Propiedad.

Al solicitar, recibir, acceder o usar los Servicios para Residentes, usted reconoce y acepta que Pest Share puede recopilar, usar y divulgar información como se describe en la Política de Privacidad y en los Términos de Servicio de Pest Share.
PLAZO Y TERMINACIÓN
Estos Términos y Condiciones para Residentes permanecen en pleno vigor y efecto mientras usted solicite, reciba, acceda o utilice cualquier Servicio para Residentes. SIN LIMITAR CUALQUIER OTRA DISPOSICIÓN DE ESTOS TÉRMINOS Y CONDICIONES DE RESIDENTE O LOS TÉRMINOS DE SERVICIO DE PEST SHARE, RESERVAMOS EL DERECHO DE, A NUESTRA EXCLUSIVA DISCRECIÓN Y CON O SIN AVISO PREVIO, Y SIN RESPONSABILIDAD SALVO LO REQUERIDO POR LA LEY APLICABLE, NEGAR, RESTRINGIR, SUSPENDER, O TERMINAR SU ACCESO O USO DE CUALQUIER SERVICIO PARA RESIDENTES, O RECHAZAR, CANCELAR, O LIMITAR CUALQUIER SOLICITUD DE SERVICIO, POR CUALQUIER MOTIVO O SIN MOTIVO, INCLUYENDO CUALQUIER INCUMPLIMIENTO REAL O SOSPECHADO DE ESTOS TÉRMINOS Y CONDICIONES PARA RESIDENTES, LOS TÉRMINOS DE SERVICIO DE PEST SHARE, LA LEY APLICABLE, LAS REGLAS DE LA PROPIEDAD, O LOS REQUISITOS DE SEGURIDAD.
Si terminamos o suspendemos su cuenta o acceso a los Servicios para Residentes por cualquier motivo, usted tiene prohibido registrarse nuevamente, solicitar o usar los Servicios para Residentes bajo su nombre, un nombre falso o prestado, o el nombre de cualquier tercero, incluso actuando en nombre de ese tercero, sin nuestro consentimiento previo por escrito. Además de terminar o suspender el acceso, nos reservamos el derecho de tomar las acciones legales apropiadas, incluyendo sin limitación la búsqueda de remedios legales o equitativos disponibles.
Nos reservamos el derecho de cambiar, modificar, suspender o descontinuar cualquier aspecto de los Servicios para Residentes en cualquier momento o por cualquier motivo sin previo aviso, incluyendo funciones del servicio, disponibilidad, alcance de cobertura, métodos de cumplimiento y prácticas de programación, y de cambiar las tarifas por servicios no cubiertos (con previo aviso razonable a usted únicamente en la medida en que dicho aviso sea requerido por la ley aplicable), sin responsabilidad alguna salvo lo requerido por la ley aplicable o cualquier acuerdo con el Administrador de la Propiedad. No podemos garantizar que los Servicios para Residentes estén disponibles en un momento, lugar o problema en particular, ni que no haya retrasos, reprogramaciones, interrupciones o errores. Podemos experimentar problemas de hardware, software u otros, o necesitar realizar mantenimiento relacionado con los Servicios para Residentes, lo que puede resultar en interrupciones, retrasos o errores. Nos reservamos el derecho de cambiar, revisar, actualizar, suspender, descontinuar o modificar de otra manera los Servicios para Residentes en cualquier momento y por cualquier motivo sin previo aviso.

Nos reservamos el derecho de cambiar, revisar, actualizar, suspender, descontinuar o modificar de otra manera los Servicios para Residentes en cualquier momento y por cualquier motivo sin previo aviso. Usted acepta que, en la máxima medida permitida por la ley aplicable, no tenemos responsabilidad por ninguna pérdida, daño o inconveniente causado por su incapacidad para acceder o usar los Servicios para Residentes durante cualquier tiempo de inactividad o descontinuación de los Servicios para Residentes. Los Servicios para Residentes no son servicios de emergencia, y Pest Share no se compromete a proporcionar respuestas inmediatas, tratamientos a demanda, asesoramiento médico, remediación, reparación o cualquier intervención de salud o seguridad.
Si usted cree que hay una emergencia, un riesgo inmediato para la salud o la seguridad, o una condición que requiera remediación urgente, comuníquese de inmediato con los respondedores de emergencia apropiados, el personal de administración de la propiedad u otros profesionales adecuados. Nada en estos Términos y Condiciones para Residentes se interpretará como una obligación nuestra de mantener y apoyar los Servicios para Residentes o de proporcionar correcciones, actualizaciones o lanzamientos relacionados con los mismos.
Estos Términos y Condiciones para Residentes y su uso de los Servicios para Residentes se rigen por y se interpretan de acuerdo con las leyes especificadas en los Términos de Servicio de Pest Share, sin tener en cuenta los principios de conflicto de leyes aplicables en la medida en que se establezcan allí.
Cualquier disputa, reclamación o controversia que surja de o esté relacionada con estos Términos y Condiciones para Residentes o los Servicios para Residentes será regida por las disposiciones de resolución de disputas, arbitraje, jurisdicción, renuncia a acciones colectivas, renuncia a juicio con jurado, elección de ley y limitaciones establecidas en los Términos de Servicio de Pest Share, los cuales se incorporan aquí por referencia y se aplican en la máxima medida permitida por la ley.
LOS SERVICIOS PARA RESIDENTES SE PROPORCIONAN EN UNA BASE DE “TAL CUAL” Y “SEGÚN DISPONIBILIDAD”, Y SU USO DE LOS SERVICIOS PARA RESIDENTES ES BAJO SU PROPIO RIESGO. EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY, PEST SHARE RENUNCIA A TODAS LAS GARANTÍAS, EXPRESAS O IMPLÍCITAS, EN RELACIÓN CON LOS SERVICIOS PARA RESIDENTES, INCLUYENDO CUALQUIER GARANTÍA IMPLÍCITA DE COMERCIABILIDAD, IDONEIDAD PARA UN PROPÓSITO PARTICULAR, TÍTULO, NO INFRACCIÓN, DISFRUTE TRANQUILO, PRECISIÓN O RESULTADOS.
SIN LIMITAR LO ANTERIOR, PEST SHARE NO GARANTIZA QUE CUALQUIER SOLICITUD DE SERVICIO SERÁ ACEPTADA, PROGRAMADA O COMPLETADA; QUE CUALQUIER TERCERO PROVEEDOR DE SERVICIOS ESTARÁ DISPONIBLE; QUE CUALQUIER TRATAMIENTO SERÁ EXITOSO, SUFICIENTE O LIBRE DE ERRORES; QUE CUALQUIER CONDICIÓN SERÁ COMPLETAMENTE RESUELTA O NO RECURRIRÁ; O QUE LOS SERVICIOS PARA RESIDENTES SEAN ADECUADOS PARA EMERGENCIAS, MÉDICAS, DE SALUD, HABITABILIDAD, ESTRUCTURALES O DE REMEDIACIÓN. PEST SHARE NO ES RESPONSABLE, EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY APLICABLE, POR LOS ACTOS, OMISIONES, PRODUCTOS, SERVICIOS O MANO DE OBRA DE CUALQUIER ADMINISTRADOR DE LA PROPIEDAD O TERCERO PROVEEDOR DE SERVICIOS, Y DICHAS PERSONAS O ENTIDADES NO SON AGENTES DE PEST SHARE A EFECTOS DE CREAR RESPONSABILIDAD HACIA USTED.
EN NINGÚN CASO NOSOTROS O NUESTROS DIRECTORES, EMPLEADOS O AGENTES SEREMOS RESPONSABLES ANTE USTED O ANTE CUALQUIER TERCERO POR DAÑOS INDIRECTOS, CONSECUENTES, EJEMPLARES, INCIDENTALES , ESPECIALES O PUNITIVOS, INCLUYENDO PÉRDIDA DE BENEFICIOS, PÉRDIDA DE INGRESOS, PÉRDIDA DE DATOS U OTROS DAÑOS QUE SURJAN DE SU USO DE LOS SERVICIOS PARA RESIDENTES, INCLUSO SI SE NOS HA ADVERTIDO DE LA POSIBILIDAD DE DICHOS DAÑOS. A PESAR DE CUALQUIER COSA EN CONTRARIO QUE SE CONTENGA AQUÍ, NUESTRA RESPONSABILIDAD CON USTED PARA CUALQUIER CAUSA Y SIN IMPORTAR LA FORMA DE LA ACCIÓN, SIEMPRE ESTARÁ LIMITADA AL MENOR DE LA CANTIDAD PAGADA, SI LA HAY, POR USTED A NOSOTROS DURANTE EL PERÍODO DE SEIS (6) MESES ANTES DE CUALQUIER CAUSA DE ACCIÓN QUE SURJA O A $5,000.
LAS LIMITACIONES ANTERIORES SE APLICAN INDEPENDIENTEMENTE DE LA FORMA DE LA ACCIÓN E INCLUSO SI ALGÚN RECURSO LIMITADO NO CUMPLE SU PROPÓSITO ESENCIAL. CIERTAS LEYES ESTATALES DE EE. UU. Y LEYES INTERNACIONALES NO PERMITEN LIMITACIONES EN GARANTÍAS IMPLÍCITAS O LA EXCLUSIÓN O LIMITACIÓN DE CIERTOS DAÑOS. SI ESTAS LEYES SE APLICAN A USTED, ALGUNAS O TODAS LAS EXCLUSIONES O LIMITACIONES ANTERIORES PUEDEN NO APLICARSE A USTED, Y PODRÍA TENER DERECHOS ADICIONALES.
Estos Términos y Condiciones para Residentes, junto con los Términos de Servicio de Pest Share y cualquier término adicional incorporado por referencia en este documento, constituyen el acuerdo completo entre usted y Pest Share con respecto a los Servicios para Residentes y reemplazan los entendimientos previos entre usted y Pest Share sobre ese tema. En caso de un conflicto directo entre estos Términos y Condiciones para Residentes y los Términos de Servicio de Pest Share, estos Términos y Condiciones para Residentes prevalecerán únicamente en lo que respecta a los Servicios para Residentes y únicamente en la medida de ese conflicto directo. Pest Share puede ceder o transferir estos Términos y Condiciones para Residentes, en su totalidad o en parte, sin restricción, y usted no puede cederlos sin el consentimiento previo por escrito de Pest Share.
Si alguna disposición de estos Términos y Condiciones para Residentes se considera ilegal, nula o inaplicable, esa disposición se considerará separable y las disposiciones restantes permanecerán en plena vigencia y efecto. Ninguna renuncia por parte de Pest Share se considerará una renuncia adicional o continua a cualquier término o condición o a cualquier otro término o condición. Nada en estos Términos y Condiciones para Residentes crea ninguna sociedad conjunta, asociación, empleo, agencia, fiduciaria o relación similar entre usted y Pest Share, cualquier Administrador de la Propiedad o cualquier tercero proveedor de servicios.
